Acceptance
These Terms of Service ("Terms") are a contract between you and Jhome Automation ("we", "us"), the operator of Gootier (gootier.jhomeautomation.com). By creating an account or using Gootier you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Gootier.
The service
Gootier is a software-as-a-service product that lets you compose, schedule, and publish social-media posts and email blasts; generate marketing copy, images, videos, and music with AI tools; and connect third-party social accounts via OAuth. Some features cost credits or require a paid subscription.
Your account
- You must provide accurate registration information and keep it current.
- You are responsible for your account credentials and for everything that happens under your account. Notify us immediately if you suspect unauthorized access.
- You must be at least 13 (or the applicable age in your country) to use Gootier, and old enough to enter into a binding contract in your jurisdiction.
- One human per account. Don't sell, transfer, or share your account.
Your content
You retain ownership of everything you upload, write, or generate with Gootier ("Your Content"). By using Gootier, you grant us a limited, non-exclusive, royalty-free license to host, process, transmit, modify (for technical purposes such as encoding and compression), and display Your Content solely to provide the service to you. This license ends when you delete the content or close your account, except where we must retain it to comply with law.
You represent that you have all the rights necessary to use Your Content with Gootier — including for any images, audio, video, or recipient email addresses you upload or reference.
AI-generated output
Gootier's AI features may produce inaccurate, biased, or otherwise unsuitable output. You are responsible for reviewing every piece of AI output before you publish, send, or distribute it. Generated output may resemble output produced for other users; we do not guarantee its uniqueness. Where required by an underlying provider's policies, you agree to follow any applicable disclosure rules when posting AI-generated content.
Connected social accounts
When you connect a Facebook, Instagram, X, LinkedIn, TikTok, or YouTube account, you authorize Gootier to publish on your behalf using the scopes you grant. You remain bound by each platform's own terms. You can disconnect at any time from the Connections page; pending scheduled posts to a disconnected account will fail and you will not be charged for the failed publish.
Acceptable use
You agree not to use Gootier to:
- send spam, run unsolicited bulk email, or harvest contact lists you have no consent to message;
- publish content that is illegal, infringing, defamatory, deceptive, harassing, sexually explicit involving minors, or that promotes violence or self-harm;
- impersonate any person or entity, or misrepresent your affiliation;
- infringe any intellectual property, privacy, publicity, or contractual right;
- circumvent rate limits, abuse our credits system, scrape Gootier, or interfere with the security or operation of the service;
- build a competing product using Gootier's outputs.
We may suspend or terminate accounts that violate these rules, and we may remove content that violates them.
Credits, subscriptions, and refunds
- Subscriptions are billed in advance through Stripe and renew automatically until cancelled. Cancel any time from the billing settings — your plan remains active through the end of the current billing period.
- Credits are consumed when you use paid features (AI generation, compose, music gen, etc.). Credits do not expire unless your account is closed. Failed paid jobs are auto-refunded to your credit balance.
- Charges already paid are non-refundable except where required by law or where we explicitly grant a refund.
- If a third-party service we rely on (a social platform, an AI provider, etc.) changes terms or pricing, we may adjust ours with reasonable notice.
Suspension and termination
We may suspend or close your account if you violate these Terms or use Gootier in a way that risks harm to us, our users, or any third party. You can close your account at any time from your profile settings; we will delete or anonymize your data as described in the Privacy Policy.
Service availability
We do our best to keep Gootier running but we don't guarantee uninterrupted or error-free service. Scheduled maintenance, third-party outages (OAuth provider down, AI vendor degraded, etc.), and unexpected incidents will occasionally affect availability.
Disclaimers
Gootier is provided "as is" and "as available", without warranties of any kind (express, implied, statutory, or otherwise), including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will meet your requirements, that any specific result will be obtained, or that AI output will be accurate or suitable for your intended use.
Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising from your use of (or inability to use) Gootier. Our total liability to you for any claim arising out of or relating to Gootier will not exceed the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) USD 50.
Indemnification
You agree to indemnify and hold harmless Jhome Automation, its officers, contractors, and partners from any claim or demand (including reasonable attorneys' fees) made by any third party arising out of Your Content, your use of the service, or your violation of these Terms or any applicable law.
Changes to the service or the Terms
We may add, remove, or change features over time. We may also update these Terms; material changes will be flagged in-app or by email and take effect 14 days after notice, unless you reject them by closing your account. Continued use after the notice period means you accept the updated Terms.
Governing law
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws principles. Disputes must be brought in the state or federal courts located in Florida, except where local consumer-protection law gives you the right to sue in your own jurisdiction.
